Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Fishcom mobile application (the "App") operated by Southeast Holdings, LLC ("us", "we", or "our"). Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms.

1. Description of Service

Fishcom is a productivity tool designed for the commercial fishing industry, providing catch logging, vessel coordination, digital bookkeeping, and supplemental weather data. Fishcom is not a navigation tool and must not be used as a primary source for maritime safety, navigation, or official weather monitoring.

2. Eligibility and Accounts

  • Account Creation: You must provide accurate information, including your legal name and vessel name.

  • Security: You are responsible for safeguarding your login credentials. You agree to notify us immediately of any unauthorized use of your account.

3. Data Ownership and Intellectual Property

  • User Data: You retain ownership of your catch locations (GPS), catch logs, and uploaded documents. You grant us a limited license to host and back up this data to provide the service.

  • Proprietary Rights: The App’s code, branding, and "Fishcom" trademarks are the exclusive property of Southeast Holdings, LLC.

  • Trade Secrets: We acknowledge that catch coordinates are commercially sensitive. We will not disclose your specific coordinates to third parties except through the sharing features you explicitly activate.

4. User Conduct and Compliance

  • Maritime Regulations: You are solely responsible for ensuring your fishing activities and record-keeping comply with all applicable local, state, and federal laws.

  • Sharing Features: Sharing your location or vessel capacity with other users is entirely at your own discretion and risk.

  • Anti-Collusion: You shall not use Fishcom messaging or data sharing for price-fixing or anti-competitive behavior.

  • Professional Conduct: Users entering "Public Notes" or "Set Notes" must remain professional. Harassment or fraudulent data entry (e.g., false vessel capacity) is prohibited.

5. Subscriptions and Billing

  • Multi-Platform Access: We offer subscriptions via In-App Purchase (Apple/Google) and via our website. Features are identical regardless of the purchase platform.

  • Fleet Licensing ("Seats"): For organizations purchasing "seats" via our website or direct invoice, access is governed by the specific service agreement between Southeast Holdings, LLC and your organization.

  • Renewal: All subscriptions are set to auto-renew unless canceled at least 24 hours before the end of the current billing cycle.

6. Weather and Forecasting Data

  • Informational Purpose Only: The App may provide weather, sea state, and forecasting data sourced from third-party providers. This data is provided for general informational purposes only and may be delayed, incomplete, or inaccurate.

  • No Reliance for Safety: You acknowledge that weather conditions at sea are volatile. You must never rely on the App as your primary or sole source for making "go/no-go" safety decisions. * Primary Sources: Users are strictly directed to monitor official maritime weather broadcasts (e.g., NOAA Weather Radio, VHF-FM) and use professional seamanship to evaluate environmental risks.

7. Limitation of Liability

To the maximum extent permitted by law, Southeast Holdings, LLC shall not be liable for:

  • Any maritime accidents, personal injury, or loss of life.

  • Damages or vessel loss resulting from reliance on weather forecasts, tide data, or atmospheric conditions displayed in the App.

  • Loss of data due to hardware damage, lack of connectivity, or sync errors.

  • Financial losses, including "lost catch" or inaccurate price/weight estimations.

8. Indemnification

You agree to defend, indemnify, and hold harmless Southeast Holdings, LLC and its affiliates from and against any and all claims, damages, and expenses (including attorney's fees) resulting from:

  • Your use of and access to the App.

  • Your breach of these Terms.

  • Any disputes between you and another user (e.g., vessel-to-tender coordination disputes).

  • Any claims arising from inaccurate catch logs or weather data reliance.

9. Disclaimers

The service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, error-free, or available in all maritime regions. Calculations and forecasts provided by the app are estimates and must be verified manually via official equipment.

10. Governing Law

These Terms shall be governed by the laws of the State of Alaska, United States. Any legal action related to these Terms shall be filed in the courts located in or serving Haines, Alaska.
